Terms of Service for the Rideshare App Vodoro
1. Scope of Application
These Terms of Service govern the use of the rideshare platform Vodoro, operated by Felix Kammerer, Am Wasen 15, 91586 Lichtenau, Germany, Email: info.vodoro@gmail.com, hereinafter referred to as "Provider".
By registering and using the platform, users (hereinafter "Drivers" and "Passengers") accept these Terms of Service.
2. Service Description
The Provider offers a platform where drivers and passengers can search for, offer, and book rideshare opportunities.
The Provider is not a contractual party to the transportation contracts concluded between drivers and passengers, but exclusively facilitates contact between them.
3. Registration and User Account
Using the platform requires registration.
Users are obligated to provide truthful information during registration.
User accounts may not be transferred to third parties.
Users must be at least 18 years old or have parental consent.
4. User Obligations
Drivers are required to have a valid driver's license, a roadworthy vehicle, and the necessary insurance coverage.
Passengers commit to paying the agreed fare and to start agreed trips punctually.
Both parties must behave respectfully and in accordance with applicable law.
Providing false or misleading information is prohibited.
Users may not use the platform for illegal purposes or to disrupt operations.
5. Bookings, Cancellations, and Payments
Bookings are made through the platform and are binding for both parties.
Cancellations must be made through the platform. The following deadlines apply:
- Cancellation by driver: Up to 2 hours before trip start free of charge, after that cancellation fees may apply
- Cancellation by passenger: Up to 4 hours before trip start free of charge, after that the full fare is due
The Provider may charge a facilitation fee of up to 10% of the fare, which is automatically deducted from the fare.
Payments are processed through the payment methods provided in the app.
6. Liability
The Provider is not liable for the execution of the trip, damages, delays, or cancellations that occur in the context of transportation.
Drivers and passengers act at their own responsibility.
The Provider is only liable for damages that are due to gross negligence or intent of the Provider.
The Provider's liability for slight negligence is excluded, unless essential contractual obligations (cardinal obligations) are violated.
Users are required to have adequate liability insurance.
7. Data Protection
The Provider processes personal data in accordance with the privacy policy and legal regulations, particularly the GDPR.

8. Suspension and Termination
The Provider is entitled to suspend or delete user accounts in case of violations of these Terms of Service or legal regulations.
Users can delete their account at any time.
In case of serious violations, immediate suspension without prior notice may occur.
9. Changes to the Terms of Service
The Provider may change these Terms of Service with effect for the future. Users will be informed of changes in a timely manner. If they do not object to the changes within 14 days, the changes are considered accepted.
10. Choice of Law and Jurisdiction
German law applies. The place of jurisdiction is, insofar as legally permissible, Ansbach, Germany.
11. Severability Clause
Should any provision of these Terms of Service be invalid, the validity of the remaining provisions remains unaffected.
